These Terms and Conditions (“Agreement”) govern all logistics, transportation, and related services (the “Services”) provided by Shaan’s Cargo Pvt. Ltd. (“Shaan’s Cargo,” “we,” “us”). By requesting or using Shaan’s Cargo’s services, every shipper, consignor, consignee, owner, client, or authorized agent (“Customer”) agrees to be bound by this Agreement.

1. Role and Services

Shaan’s Cargo may act as a logistics service provider, freight forwarder, or transportation broker, arranging the movement of goods (“Cargo”) through third-party carriers, agents, and service partners. Shaan’s Cargo is responsible for coordination and facilitation but may not always perform transportation physically.

2. Bookings, Quotes, and Pricing

All bookings are subject to acceptance by Shaan’s Cargo and depend on the accuracy of information supplied by the Customer regarding cargo, documentation, and routing. Freight rates and service fees are based on details provided at quotation and may change if shipment details or requirements differ at booking or execution. Rates do not include duties, taxes, port or government charges unless expressly stated.

3. Payment Terms

Payment for all services rendered must be made within the timeline specified on Shaan’s Cargo invoices (typically within 30 days of invoice date). Any disputes to invoiced charges must be raised in writing within 10 business days; undisputed invoices are deemed accepted and payable. Overdue invoices may attract a late fee or interest as allowed by law, and Shaan’s Cargo reserves the right to withhold services or cargo pending payment of outstanding balances.

4. Cargo Acceptance and Condition

The Customer is responsible for ensuring cargo is properly packed, labeled, and classified (including any hazardous, perishable, or special handling requirements), and for providing accurate shipping documentation and instructions. Shaan’s Cargo and its partners reserve the right to refuse carriage for improperly documented or dangerous items.

5. Liability and Claims

Shaan’s Cargo arranges transportation using reputable carriers and service providers but does not assume carrier liability unless expressly agreed in writing. Claims for cargo loss, damage, or delay must be reported to Shaan’s Cargo and the carrier in writing within 9 months of delivery or expected delivery date, supported by all relevant documents (including bill of lading, delivery note, and commercial invoice). Filing a claim does not relieve the Customer’s obligation to pay freight and related charges.

Shaan’s Cargo’s maximum liability is the actual value of the lost or damaged goods (subject to statutory limits, carrier limitations, or specific written agreements). In no event shall Shaan’s Cargo be liable for indirect, consequential, punitive, or business losses.

6. Insurance

Insurance on cargo is not automatically included. The Customer may request additional cargo insurance coverage through Shaan’s Cargo for an extra charge, which is only effective upon written agreement and payment.

7. Force Majeure

Shaan’s Cargo is not liable for delays, losses, or failures in performance caused by circumstances beyond our direct control, including but not limited to acts of nature, government actions, labor disputes, war, terrorism, or disruptions to carrier operations.

8. Customer’s Obligations

The Customer warrants compliance with all applicable laws, regulations, and international conventions regarding the transportation of cargo. All information and instructions provided must be accurate and complete. The Customer is responsible for payment of duties, taxes, and associated charges unless stated otherwise.

9. Indemnity

The Customer agrees to indemnify and hold harmless Shaan’s Cargo, its agents, and partners from any claims, liabilities, or expenses arising from (a) inaccurate documentation, (b) breach of contract, (c) violations of law, or (d) third-party claims related to the goods or services rendered under this Agreement.

10. Lien

Shaan’s Cargo retains a general and continuing lien over customer property, cargo, and shipping documents in its possession, pending full payment of all charges due (including unpaid prior shipments). If payment is not received after reasonable notice, Shaan’s Cargo reserves the right to sell, dispose of, or otherwise deal with the goods at the Customer’s cost.

11. Limitation of Actions

Any legal action arising from the provision of services or related to a claim must be commenced within one (1) year from the date of delivery (or expected delivery) of the cargo.

12. Changes to Terms

Shaan’s Cargo reserves the right to update or modify these Terms & Conditions at any time. The latest version will be posted on our Website and is effective upon publication. Continued use of our services implies acceptance of the updated Terms.

13. Governing Law and Jurisdiction

This Agreement shall be construed under the laws of India, and any disputes arising from these terms or the provision of services shall be subject to exclusive jurisdiction of the courts in Coimbatore, Tamil Nadu.
